Unconscionability

Unconscionability in contract law refers to a situation where a contract is so unfair or one-sided that it shocks the conscience. It typically occurs when one party has significantly more power or knowledge than the other, leading to an unfair advantage. Courts may refuse to enforce such contracts if they believe that enforcing them would be unjust. This often applies in cases of high-pressure sales, hidden terms, or exploitation of vulnerable individuals. In essence, it protects against extremely unfair agreements that no reasonable person would accept.
