Negligence
Negligence refers to a failure to exercise the care that a reasonably prudent person would in similar circumstances, leading to unintended harm or damage. It involves four key elements: a duty of care owed by one party to another, a breach of that duty, causation linking the breach to the harm suffered, and measurable damages. Common examples include car accidents caused by distracted driving or medical malpractice. Essentially, negligence occurs when someone's actions—or lack of action—fall short of what is expected, resulting in injury or loss to another party.
