
Constructive Discharge
Constructive discharge occurs when an employee resigns because their work environment has become intolerable due to severe mistreatment, discrimination, or breach of contract by the employer. Instead of being formally fired, the employee feels they have no choice but to leave due to the employer's actions, which create a hostile or unbearable situation. In wrongful termination cases, this can be argued as an unlawful termination if the employer's conduct effectively forced the resignation, entitling the employee to seek legal recourse for damages.
