
Delegation of Duties
Delegation of duties refers to the process where one party in a contract allows another party to perform their obligations under that contract. In the context of third-party rights, this means that a party can transfer their responsibilities to someone else, but the original party remains ultimately accountable for fulfilling the contract. While the third party may have rights related to the performance, the person who delegated the duty cannot simply wash their hands of responsibility if things go wrong. This helps ensure that obligations are met, while allowing for flexibility in who carries them out.
