
Warrantless Search
A warrantless search occurs when law enforcement officers search a person, property, or vehicle without first obtaining a search warrant from a judge. While the Fourth Amendment of the U.S. Constitution protects against unreasonable searches, there are exceptions that allow warrantless searches. These include situations where officers have probable cause, consent is given, or there is an imminent threat, such as evidence being destroyed. Although warrantless searches can be controversial, they are permitted under certain circumstances to balance law enforcement needs with individual rights.
