Restitutionary claims arise when one party benefits at the expense of another without a legal basis to do so. Essentially, if someone unfairly gains from your loss or someone else’s sacrifice, you may be entitled to compensation. This principle aims to restore fairness by requiring the person who benefited to return or compensate for the value received. Examples include situations involving unjust enrichment, where an individual receives money or property without providing something of equal value in return, and scenarios where services are provided but not compensated.
