Marital property division

Marital property division is the process of fairly distributing assets and debts acquired during a marriage when a couple divorces or separates. Typically, property gained during the marriage is considered joint property, regardless of whose name is on it. Courts aim for an equitable (fair) split, which may not always mean equal, based on factors like each spouse’s contributions, needs, and circumstances. Property acquired before marriage or through inheritance might be separate property, but laws vary. The goal is to resolve ownership fairly, ensuring both parties receive a just share of their combined assets and obligations.
