Legal Rights of ESAs

Emotional Support Animals (ESAs) are not considered pets but are recognized for providing comfort and emotional benefits to individuals with certain mental or emotional conditions. Under laws like the Fair Housing Act, landlords must accommodate ESAs, allowing them in housing even with pet restrictions, without extra fees. However, ESAs are not granted public access rights like service animals. To qualify, a licensed mental health professional must confirm the animal's role in helping manage a diagnosed condition. ESAs do not have the same legal protections as service animals, but they are protected in specific areas such as housing and, in some cases, air travel.
