Lack of informed consent in medical malpractice law occurs when a doctor fails to adequately inform a patient about a treatment or procedure, including its risks, benefits, and alternatives. Before undergoing any medical intervention, patients should understand what to expect and have the opportunity to ask questions. If a patient is not properly informed and suffers harm as a result of a procedure they might have avoided or approached differently, they may have grounds for a legal claim against the healthcare provider for not obtaining informed consent.
