
Constructive Eviction
Constructive eviction occurs when a landlord fails to maintain a rental property, making it unlivable or significantly uncomfortable for the tenant. This could include issues like severe plumbing problems, lack of heat, or hazardous conditions. When the tenant can no longer live in the space due to these conditions, they may legally consider themselves "evicted," even if the landlord hasn't formally evicted them. To act on this, tenants often must notify the landlord of the issues and give them a chance to fix them before taking further steps, such as terminating the lease or seeking legal remedies.
