Agency by necessity refers to a legal concept where a person (the agent) must act on behalf of another (the principal) without prior consent, typically in emergencies or unavoidable situations. This occurs when the agent's actions are essential to prevent significant harm or loss to the principal’s property or interests. For example, if someone finds a friend’s dog in danger and takes immediate action to save it, they may be recognized as acting under agency by necessity. This principle ensures that urgent situations are handled promptly, even without explicit permission.
