Actual Breach

An actual breach of contract occurs when one party fails to fulfill their obligations as outlined in the agreement, either by not performing on time, not performing at all, or doing so poorly. For example, if a contractor agrees to build a fence by a certain date but fails to complete it, they have committed an actual breach. This failure gives the other party the right to seek remedies, such as demanding performance, claiming damages, or ending the contract. In essence, it's a clear violation of the terms agreed upon by both parties.
