Unjust Retention

Unjust retention refers to a situation where one party benefits at another party's expense without a valid reason. In the context of unjust enrichment, it occurs when someone keeps money, property, or services they received, but it would be unfair for them to keep it because it rightfully belongs to someone else. For example, if a contractor is paid in advance for work but fails to complete it, they may be unjustly retaining that payment. The idea is that fairness demands they return what doesn't rightfully belong to them.
