Title defenses
Title defenses are legal arguments used by the owner of a property or security interest in a lawsuit to challenge or invalidate a claim of ownership or rights made by another party. They are typically used in cases where someone tries to foreclose on a mortgage or take ownership of property. Common defenses include arguing that the lender failed to follow proper procedures, the debt was paid, or the agreement was invalid. Essentially, title defenses are reasons the defendant provides to show they should not be held responsible or that the claim against the property is incorrect.
