The Trespasser
A trespasser is someone who enters another person's property without permission. Legally, property owners generally do not owe a duty of care to trespassers, meaning they aren't responsible for injuries caused by natural hazards or dangers on the land, unless the owner has intentionally caused harm or is aware of the trespasser's presence. However, if the owner knows about frequent trespassing, especially by children, they may have a duty to warn or protect against hidden dangers. The concept balances property rights with safety interests, differentiating trespassers from lawful visitors who have permission to be on the property.
