
The Miller Test
The Miller Test is a legal guideline used to determine if material is considered obscene and therefore not protected by free speech laws. It involves three criteria: first, whether the average person would find that the material appeals to sexual lust; second, whether it depicts sexual conduct in a way that violates community standards; and third, whether the material lacks serious literary, artistic, political, or scientific value. If all three are satisfied, the material can be legally classified as obscene and restricted.
