Takings Law

Takings Law refers to the constitutional principle that the government cannot take private property for public use without providing just compensation to the owner. Under the Fifth Amendment, "taking" can occur through direct appropriation or regulations that effectively deny property owners of its economic value. Courts analyze whether a regulation goes beyond reasonable limits, transforming a restriction into a taking, which would require compensation. Essentially, Takings Law balances public needs with protecting individual property rights, ensuring that government actions don't unjustly deprive owners of their property without fair compensation.
