
Statutory easement
A statutory easement is a legal right granted by law that allows a person or entity to use another person's property for a specific purpose, such as accessing a roadway or utility lines. Unlike ownership, it doesn’t transfer property rights but gives limited usage rights. These easements are established through legislation rather than individual agreements, often to ensure public access, safety, or infrastructure maintenance. Once created, the easement remains attached to the property, even if it is sold, and can usually be used without transferring ownership of the land itself.
