Smith Act

The Smith Act, enacted in 1940, is a U.S. law that makes it illegal to advocate for the overthrow of the government or to organize groups that do so, if such actions are intended to be carried out. It was originally aimed at combatting communist groups during the Cold War era. The law criminalizes not just violent actions but also the mere encouragement or conspiracy to oppose the government itself. While it aims to protect national security, it has also raised concerns about free speech and political activism, making it a significant and sometimes controversial piece of legislation.
