privity exception

The privity exception refers to a legal concept where certain contractual protections or claims extend beyond the original parties involved in a contract. Normally, only those directly part of an agreement have rights or obligations under it. However, the privity exception allows third parties—those not directly in the contract—to enforce rights or seek remedies if they are closely affected or intended beneficiaries. This exception recognizes situations where fairness or justice warrants involving outside parties, even if they weren't original signatories to the contract.
