Normative Jurisprudence

Normative jurisprudence is the branch of legal philosophy that explores questions about how laws ought to be, rather than how they actually are. It seeks to understand the principles and values that underpin justice, fairness, and morality in the legal system. Essentially, it examines what law should be, offering ideas about the ideal laws and legal reasoning that promote a just society. This contrasts with descriptive law, which focuses on describing and analyzing existing laws and legal systems.
