Negligent Infliction of Emotional Distress (NIED) refers to a legal claim where a person suffers emotional harm due to someone else's careless actions. Unlike physical injuries, NIED focuses on psychological impact. For example, if a person witnesses a traumatic event caused by someone’s negligence, they may experience severe emotional distress, such as anxiety or depression. To succeed in an NIED claim, the affected person usually must show that the defendant's negligence was a direct cause of their emotional suffering and that it was a foreseeable consequence of the defendant's actions.
