Mutual Consent
Mutual consent in contract law refers to the agreement between two parties to enter into a contract. It means that both parties have a clear understanding of the terms and conditions and voluntarily agree to them. This requires an offer made by one party and acceptance of that offer by the other, along with a shared intention to create a binding agreement. Mutual consent ensures that both parties are on the same page and are legally committed to fulfilling their respective obligations under the contract. Without mutual consent, a contract may not be enforceable.
