
Miller Test
The Miller Test is a guideline used by courts to determine if material is legally considered obscene, and therefore not protected by free speech rights. It involves three questions: First, whether the material appeals to prurient (sexual) interest using community standards. Second, whether it depicts sexual conduct in a way that's considered offensive according to law. Third, whether it lacks serious literary, artistic, political, or scientific value. If the material meets all three criteria, it can be deemed obscene and legally restricted. The test helps balance free expression with community moral standards.
