La ganancialidad is a legal principle in marital property law, primarily in Spanish and some Latin American systems, which states that assets acquired during marriage are jointly owned by both spouses, regardless of whose name they are in. This means that any income, savings, or property accumulated during the marriage are considered part of a common estate, to be divided equally if the marriage ends, whether by separation, divorce, or death. It promotes fairness by recognizing the shared effort and contributions of both spouses in building the household’s assets.
