Istihsan

Istihsan is an Islamic legal concept allowing scholars to choose a relaxed or more equitable ruling when strict adherence to strict legal rules causes hardship or unfairness. It acts as a form of judicial discretion, prioritizing justice and the public good over rigid application of laws. Essentially, if a clear legal rule leads to hardship, a scholar can invoke Istihsan to adopt a more reasonable or compassionate judgment, ensuring the law serves justice while maintaining the Qur'an and Sunnah as foundational sources.
