Equitable Fraud

Equitable fraud occurs when someone uses deceit or misrepresentation to gain an unfair advantage, relying on the victim's trust or ignorance. Unlike criminal fraud, which involves criminal charges, equitable fraud is addressed in civil courts through fairness and justice. It involves situations where false statements, concealment of important facts, or other deceptive practices lead another person to make decisions they wouldn’t have made if they had the correct information. The goal is to prevent unjust enrichment and ensure fairness, often resulting in the court ordering the wrongdoer to compensate the victim or undo the unfair transaction.
