Eligibility and Entitlement

In the context of Family and Medical Leave Law, "eligibility" refers to whether an employee meets specific criteria, such as length of employment and hours worked, to take unpaid leave. "Entitlement," on the other hand, refers to the actual right to take a certain amount of leave for qualifying reasons, such as a serious health condition or caring for a family member. Essentially, eligibility is the threshold to qualify for leave, while entitlement defines the amount of leave you can take once you are eligible.
