Dolan v. City of Tigard

Dolan v. City of Tigard (1994) was a Supreme Court case assessing whether a city’s demand for a land dedication as a condition for granting a building permit violated the U.S. Constitution’s Due Process and Takings Clauses. The city wanted the developer to set aside land for flood control and a bike path. The Court ruled that such conditions must solely serve a legitimate public purpose related to the development, and cannot be excessive or arbitrary. The decision clarified that land-use conditions must fairly relate to the development’s impact, balancing public needs with property rights.
