
Dischargeability Complaint
A Dischargeability Complaint is a legal process in bankruptcy where a creditor challenges whether certain debts should be eliminated (discharged) or must still be paid. This typically happens when the debtor believes that a debt arises from misconduct, fraud, or other circumstances that make it non-dischargeable under bankruptcy law. If the court agrees, the debt remains owed outside of bankruptcy, meaning the debtor still has to pay it. Conversely, if the court finds the debt dischargeable, the debtor is released from that obligation. This process ensures that only appropriate debts are wiped out through bankruptcy.
