Arbitration in employment law is a process where disputes between employees and employers are resolved outside of the courtroom. Instead of going to trial, both parties agree to present their case to an impartial third party, called an arbitrator. The arbitrator listens to each side and makes a binding decision. This process is generally quicker and less formal than litigation and aims to provide a fair outcome while maintaining confidentiality. Many employment contracts include arbitration clauses, meaning disputes must be resolved this way rather than through traditional court proceedings.
