Affirmative Asylum

Affirmative asylum is a legal process in the United States that allows individuals who face persecution in their home countries to seek protection. It is available to those who fear harm due to factors like race, religion, nationality, political opinion, or membership in a particular social group. Applicants must file their request with U.S. Citizenship and Immigration Services (USCIS) within one year of arriving in the U.S. If granted asylum, individuals can stay in the country and may eventually obtain a green card. This process is separate from defensive asylum, which is used during removal proceedings.
