638 Contracting (Public Law 93-638)

Public Law 93-638, also known as the Indian Self-Determination and Education Assistance Act, allows federally recognized Native American tribes to directly contract with the U.S. government to operate programs and services that were traditionally managed by federal agencies. This law, often called “638 Contracting,” empowers tribes to have more control over their affairs, including areas like health, education, and infrastructure, fostering self-governance and tailored solutions. Instead of federal oversight, tribes can manage these programs independently, promoting sovereignty and ensuring services better meet their community needs.
